TERMS AND CONDITIONS

By paying a deposit you are agreeing to these Terms and Conditions.

Any typographical, clerical or other accidental errors or omissions in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Seller shall be subject to correction without any liability on the part of the Seller.

The Photographer shall not be liable to the Customer for any failure, in whole or in part, to fulfil their obligations under an Order where failure arises as a result of an event or circumstances beyond his control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.

The Photographer shall be entitled to sub-contract his obligations under an Order at their discretion.

The provisions of these Terms and Conditions are in addition to and do not affect the Buyer’s statutory rights as a consumer.

Confidentiality
We respect your confidentiality; your personal information, contact details and payment information will not be shared with any other company. Please see our privacy policy for how we handle your data.

Deposits & Payment Terms
Payment can be made through a number of methods; we accept all major credit and debit cards, PayPal and cash.

Deposits for photo shoots are £50 to secure your chosen package and are non-refundable but can be transferred to a different date and time once only. Transfers cannot be made to other services or products. Photo shoots will not be made without an advance deposit.

Photo shoots that are re-scheduled less than 24 hours before the booked time will lose their deposit. Photo Shoot Bookings that fail to show will lose their deposit.

No shows, after 20 mins of shoot start time without notification of running late or unable to make sitting, sitting will be cancelled without refund.

Orders for any additional prints, enlargements, canvas prints, digital files or other services and products must be paid in full at the time of order. Once the order has been confirmed by both parties and are in process, changes and refunds are not permitted.

We expect payment on delivery of the goods of the order placed; on completion of the Photographer’s obligations under an Order, the Photographer shall deliver an invoice for the Price to the Customer and the Customer shall pay the Price (or any balance of it) within 30 days of the date of the invoice. Any sum outstanding after the expiry of 30 days shall have the following consequences; an interest rate of 3% per annum above the base rate of Lloyds TSB Bank plc shall accrue in respect of any outstanding sum after the 30 day period.

Commercial Photography is invoiced with finished edited images; payment is expected on delivery with a 30 day grace period. The photographer shall deliver an invoice for the Price to the Customer and the Customer shall pay the Price (or any balance of it) within 30 days of the date of the invoice. Any sum outstanding after the expiry of 30 days shall have the following consequences; an interest rate of 3% per annum above the base rate of Lloyds TSB Bank plc shall accrue in respect of any outstanding sum after the 30 day period.

After 30 days in an overdue state, the photographer reserves the right to apply a £40 late payment charge.

Health & Safety Policy
Studio Shotz Photography is fully insured for public and employee liability.

Studio Shotz Photography takes every reasonable effort to ensure the studio premises and equipment is deemed as suitable and safe for all users at all times. The Client is fully responsible for their own action, and responsible for the children they are in the accompany of, and any damages or breakages to the property that incur as a result of the Clients action shall be the responsibility of the Client to pay or rectify as agreed with Studio Shotz Photography. Photographic sessions can involve some physical activity, which is undertaken at your own risk.

We do not accept any responsibility for loss or damage to any personal belongings in or outside the studio premises.

We request that all clients advise of any special or medical requirements, including sensitivity to flashing lights, prior to the photo shoot booking.

Vouchers/Credit

One voucher or special offer permitted per sitting.

Gift Vouchers can be used to obtain the specific listed services and products shown on the gift voucher at Studio Shotz, but cannot be exchanged for their monetary sum. We reserve the right to refuse gift voucher bookings during our busy times. Gift Vouchers and Online Bookings have an expiry date of 3 months from purchase. Gift Vouchers can only be booked in using their unique reference code.

Expired gift vouchers have no monetary value, or hold no service worth.  Out of date gift vouchers are only usable at the discretion of the photographer only; this includes limits or removal or products and restricted time of use (e.g. Midweek bookings only) and additional ‘late fee’ payments. 

Customer Online Albums
Our customer online albums are for viewing only; images are not to be saved, used or published without our prior consent and is classified as a breach of copyright and we reserve the right to remove your photographs from view.

Password Protected Customer Albums be online for a maximum of 30 days. After this time the album goes ‘offline’ and is no longer available to view or purchase from. If an online album is requested to be put back online, this is done at the photographer’s discretion and can be refused.

Customer Albums that have exceeded the duration of their ‘online status’ have gone ‘offline’ and have not used their ‘credit’, ‘code’ or ‘included’ products will lose their print credit, discount code or included package items.

We are not responsible for other parties viewing client albums and images who obtain passwords from any third party. We will not hand out login, password or booking information to anyone besides the client or any approved persons by this client.

Copyright
All images on this website are under the copyright of Zelda de Hollander t/a Studio Shotz Photography. You may not sell, publish, licence, copy, store digitally or otherwise distribute any of these images without the written permission of the photographer.

Copyright in all Material is retained worldwide by the Photographer at all times and nothing shall be deemed as a release, transfer, assignment or other disposal of the Photographer’s rights in the Material.

The 1988 Copyright Act assigns the copyright of the photographs to The Photographer(s). It is therefore contrary to the Act, and illegal, to copy photographs, or allow to be copied, by any means photographic or otherwise, by any person or machine other than by The Photographer(s) or their appointed agents.

The Client shall not reproduce, in any form, including but not limited to photocopying, scanning, displaying on a computer, and on the internet images created by Studio Shotz Photography without prior written agreement and terms.

The Client agrees that Studio Shotz Photography has the unrestricted right and permission to copyright and use, re-use, publish, and republish photographic portraits or images produced for the Client made through any and all media for illustration, art, promotion, advertising, trade, or any other purpose whatsoever.

We do offer a ‘no advertisement’ contract which prevents us from showcasing any images from your photo shoot in any form of advertisement. This can be obtained prior to your shoot by contacting us directly.

Image Retention, Archive & Destruction
The original digital files will be retained for a period of 6 months from the date of the sitting, they are then securely destroyed.

Liability 
The Client will indemnify Studio Shotz Photography against all claims, liability, damages, costs and expenses, including legal fees and expenses as a result of use of images or images modified by the Client for which no permission was granted. If no release exists in writing then no release or permission exists.

The Client indemnifies Studio Shotz Photography against all claims, liability, damages and expenses incurred in connection with any third party claim arising out of the use of such material. The liability for any claim is limited to the total invoice amount.

Refund & Exchange Policy
Returned items should be in its original presentation folder, mount or frame with the original packaging and documentation.  Due to the nature of having to process our images after the prompt of sale; refunds will only be issued on faulted goods. We shall replace the item or if this is not possible issue a full refund, excluding the delivery charge. The cost of returning the item to us is your responsibility.

Digital Images (including but not limited to ‘CDs of Images’, ‘USB sticks’ and ‘Electronic Transfers’), stock images and all downloadable imagery is non-refundable due to the nature of the product. Customers that purchase digital images, we cannot guarantee print quality from your own supplier.

In the unlikely event of manufacturing fault, it will be repaired. You accept that a photograph when enlarged may lose some definition and that a colour variation may occur especially when comparing to on screen proofs and visuals to a printed, finished product(s). If a product is delivered to you damaged on arrival please reject the delivery with the courier driver. We will then produce the order again and dispatch this out to you as soon as possible.

The Distance Selling Regulations provides you with a statutory right to cancel your order and receive a full refund for any home delivery item. This does not apply to a printed product produced from a photograph provided by you.

To cancel, you can email us or write to us within seven working days (so not including Saturdays, Sundays or public holidays) commencing the day after the day of delivery of you item(s).

In the event that you decide to cancel your order, we would ask that you please notify us immediately as all our photo products are one-off, bespoke items. No order which has been accepted by the Seller may be cancelled by the Buyer except with the agreement in writing of the Seller on the terms that the buyer shall indemnify the Seller in full against all loss (including loss of profit), costs (including the cost of labour and materials used), damaged, charges and expenses incurred by the Seller as a result of the cancellation.

Complaints or claims must be notified to us in writing as soon as possible. In the case of non-delivery, in a reasonable time after the good were expected to arrive. See our returns policy above.

Refunds will be issued on card only. This process can take up to 12 working days, and will show on your next month’s bank statement.

Shipping Information

UK Delivery Only. For International Delivery please contact us directly.

Shipping is Standard Royal Mail First Class Packages. ‘Large’ & ‘Bulky’ Items are shipping by courier. Customer Orders placed through our Password Protected Albums to the UK are free 1st Class Postage to the UK. Large & Bulky Items are hand delivered, or delivered by courier for free. For international deliveries, please contact us for a quotation.

Gift Voucher Purchases are charged at; UK – Free Shipping. Gift Voucher Purchases for International clients is charged at £5 per order.

Rush Delivery
Our standard editing time for photo shoots (from shoot to online) is 7 working days; if you require your images to be fast tracked please advise us beforehand. Processed within 24 hours costs £150, the same day costs £250. Anyone that asks for advanced editing on their shoot day will be not be fast tracked.

Our Wall Art Products take approximately 14-21 working days, to fast track this to 3 – 4 working days we will quote a bespoke fast track charge. Our prints and digital services can be fast tracked to 48 hours, please contact us for a bespoke fast track charge.
